High Court Will Not Take On Benlate Case

Law360, New York (April 21, 2008, 12:00 AM EDT) -- A long-running product liability dispute between E.I. du Pont de Nemours & Co. and a group of Hawaiian plant nurseries came to a close Monday when the U.S. Supreme Court declined to hear a case involving the fungicide Benlate.

In denying the nurseries' petition for a writ of certiorari, the high court guaranteed that they would not be able to reopen settlements reached with DuPont in 1994 and 1995.
