Appeals Court Revives Parents' Suit Against Gerber

Law360, New York (April 23, 2008, 12:00 AM EDT) -- An appeals court has reversed a lower court's dismissal of a proposed class action that alleges baby-food giant Gerber Products Co. misleadingly labeled its fruit juice snacks as healthful products.

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit said Monday that the packaging of the product does have features that could likely deceive a consumer.
