How TS Tech Impacted The Northern District Of Calif.

Law360, New York (June 06, 2014, 10:26 AM ET) -- In late 2008, In re TS Tech altered the legal landscape governing motions to transfer. The Federal Circuit ruled that courts do not have unbridled discretion on whether to grant motions to transfer. The Federal Circuit proclaimed that “the [TS Tech] district court clearly abused its discretion in denying transfer from a venue with no meaningful ties to the case.”[1] The Federal Circuit sent a clear message: District courts’ decisions on motions to transfer are not untouchable.
