USPTO Refuses Again To Reissue Lipitor Patent

Law360, New York (April 28, 2008, 12:00 AM EDT) -- The U.S. Patent and Trademark Office has again rebuffed Pfizer Inc.’s bid to reissue one of the patents behind its blockbuster cholesterol drug Lipitor.

Pfizer disclosed Friday that the agency had issued its second preliminary rejection of U.S. Patent Number 5,273,995, marking a further setback in the pharmaceutical giant’s quest to extend its U.S. market exclusivity for Lipitor until June 2011.
