Expanding HHS OIG Exclusion Authority, Civil Penalties

Law360, New York (June 16, 2014, 10:17 AM EDT) -- The U.S. Department of Health and Human Services Office of Inspector General recently proposed new rules related to its permissive exclusion and civil monetary penalty authority, respectively. If these proposed rules are finalized, it could result in a greater number of instances in which providers are excluded from participation in federal health care payor programs. It could also increase the frequency with which the OIG imposes civil monetary penalties for various conduct and the amounts involved. Some of the material proposed rule changes follow below....
