Whirlpool Sues Over Mixer Shape Trademark

Law360, New York (May 1, 2008, 12:00 AM EDT) -- Whirlpool Corp. has launched a trademark infringement suit against a subsidiary of Italian appliance maker De'Longhi SpA, claiming the company’s stand mixers infringe a shape trademarked by Whirlpool brand KitchenAid.

The suit, announced Wednesday by Whirlpool, was filed against De'Longhi unit Kenwood Limited in the High Court of Justice in London.

Whirlpool and its subsidiaries Whirlpool Properties and KitchenAid Europa claim the shape of Kenwood’s kMix mixers infringes the shape of the KitchenAid stand mixer, which has been used since 1937 and is a registered trademark....
