9th Circuit Rejects NLRB’s Ruling On Button Ban

Law360, New York (May 20, 2008, 12:00 AM EDT) -- An appeals court has found that the National Labor Relations Board did not have enough evidence to support its decision allowing a Spokane, Wash., hospital to prohibit its nurses from wearing a union button.

The U.S. Court of Appeals for the Ninth Circuit ruled Tuesday that the NLRB failed to show how Sacred Heart Medical Center’s ban on “RNs Demand Safe Staffing” union buttons was justified by special circumstances and did not constitute an unfair labor practice.
