Fosamax Plaintiffs Try To Force Merck's Hand

Law360, New York (May 21, 2008, 12:00 AM EDT) -- The Fosamax plaintiffs have demanded that Merck & Co. turn over a slew of documents, a request that the pharmaceutical giant has balked at as the multidistrict litigation over whether the osteoporosis drug leads to a painful deterioration of the jaw continues to move toward trial.

On Friday, the plaintiffs filed a motion to compel in the U.S. District Court for the Southern District of New York after Merck refused to turn over the pre-2003 documents previously requested.
