Judge Won't Allow Expert To Testify In MTBE Case

Law360, New York (May 21, 2008, 12:00 AM EDT) -- A federal judge has ruled that an expert cannot testify in a case brought by residents of a New York town who allege that their groundwater wells were contaminated by gasoline additive methyl tertiary-butyl ether.

Judge Shira Scheindlin of the U.S. District Court for the Southern District of New York said Tuesday that Dr. William S. Cain can't testify in the suit the residents of Fort Montgomery, N.Y., brought against the owners and suppliers of the two gas stations that they blame for the contamination....
