Senators Urge FCC To Put Conditions On Sirius, XM

Law360, New York (May 22, 2008, 12:00 AM EDT) -- Two U.S. senators have asked the Federal Communications Commission to force XM Satellite Radio Holdings Inc. and Sirius Satellite Radio Inc. to sell up to half of their radio spectrum as a condition of their merger.

In a letter Wednesday to FCC Chairman Kevin Martin, Sens. Claire McCaskill (D-Mo.) and Olympia Snowe (R-Maine) suggested that the commission consider the divestiture of the spectrum as well as other conditions, such as not allowing exclusive agreements with automakers that would exclude other technologies.
