Express Scripts Settles Drug-Switch Case For $9.5M

Law360, New York (May 28, 2008, 12:00 AM EDT) -- Pharmacy-benefits manager Express Scripts Inc. has agreed to pay $9.5 million to settle allegations that it encouraged doctors to switch patients to different brand-name prescription drugs as a cost-saving measure without adequately informing physicians of the effect on patients and health plans.

The deal, which was announced Tuesday by the 30 attorneys general involved, ends an investigation that began in 2004.
