N.Y. Court Says Restrictive Covenant Enforceable

Law360, New York (May 30, 2008, 12:00 AM EDT) -- A New York state appeals court has handed a victory to accounting firm Weiser LLP in its battle to enforce partnership agreement provisions against three former partners who left the firm to start their own company.

A unanimous panel of the New York Appellate Division, First Department ruled Thursday that the restrictive covenant and liquidated damages provisions in Weiser's partnership agreement were prima facie enforceable.

Douglas Phillips, chairman of Weiser, applauded the ruling Thursday.
