Judge Rules Duke Pension Plan 'Age Neutral'

Law360, New York (June 4, 2008, 12:00 AM EDT) -- A federal judge has followed the lead of three circuit courts in ruling that cash balance pension plans are not inherently discriminatory as claimed by a group of Duke Energy Corp. employees.

Judge Bryan Harwell, presiding over the workers' challenge to the power company's retirement plan in the U.S. District Court for the District of South Carolina, tossed the majority of their claims on Monday and dismissed as moot their bid for class certification.
