Employers Face More Association Bias Claims

Law360, New York (June 5, 2008, 12:00 AM EDT) -- Association discrimination lawsuits are on the rise against employers, but employees still have a tough road ahead to win their cases.

In four recent cases before federal appeals courts, employees alleging discrimination based on their association with another individual have been able to prevail on their employers’ summary judgment motions.

While their ability to jump through this hoop may encourage more workers to sue, a series of obstacles stand in the way of clinching a victory.
