Judge Nixes AWP Plaintiffs' Appeal For Class Counsel

Law360, New York (June 6, 2008, 12:00 AM EDT) -- An appeals court has shot down a bid by consumer class representatives in the multidistrict litigation over average wholesale drug prices to reverse a judge’s declaration that their attorneys are unfit to serve as co-lead counsel, ruling that disqualification orders are not appealable.

The U.S. Court of Appeals for the First Circuit on Wednesday dismissed the plaintiffs' appeal of Judge Patti B. Saris’ Jan. 4 order striking Donald Haviland, the managing partner of the Haviland Law Firm LLC, as class counsel in the case.
