Philips In 'Tying' Setback At Federal Circuit

Law360, New York (March 28, 2006, 12:00 AM EST) -- In a setback for U.S. Philips Corp., the U.S. Court of Appeals for the Federal Circuit has ruled that patent misuse claims against the consumer electronics giant should be reconsidered in light of the U.S. Supreme Court’s recent anti-tying decision in the Illinois Tool Works case.

The patent misuse claims, filed by Taiwanese digital multimedia firm Princo Corp., alleged Philips used licensing agreements to illegally tie unnecessary patents to those required to manufacture recordable compact discs (CD-Rs).
