AWP Judge Sends Utah Complaint Back To State Court

Law360, New York (June 10, 2008, 12:00 AM EDT) -- Drug companies at the center of multidistrict litigation over falsely inflated average wholesale drug prices have lost their bid to keep the state of Utah's claims before a federal judge.

U.S. District Judge Patti B. Saris of the District of Massachusetts issued an order Monday remanding the case to state court, more than six months after the state filed its original complaint in the venue under Utah's False Claims Act.
