11th Circ. Remands Part Of Ala. Mill Case To EPA

Law360, New York (June 17, 2008, 12:00 AM EDT) -- A federal appeals court has issued a mixed ruling in a case challenging the U.S. Environmental Protection Agency's decision to apply strict pollution standards to equipment used in manufacturing oriented strand board at a Louisiana-Pacific Corp. mill in Alabama.

The U.S. Court of Appeals for the Eleventh Circuit sided with the EPA in its determination that the drying system at the wood products mill should fall under a provision in the Clean Air Act governing emissions from new industrial boilers.
