Law360, New York (June 17, 2008, 12:00 AM ET) -- Two inventors have won their bid to dismiss counterclaims filed by Seyfarth Shaw LLP and Burnett, Burnett & Allen in a lawsuit accusing the law firms of malpractice in the prosecution of a separate infringement action over two patents for snowboard bindings.
On Tuesday, Judge Jeffrey S. White of the U.S. District Court for the Northern District of California granted the plaintiffs' motions to toss the firms' counterclaims for declaratory judgment of invalidity, unenforceability and noninfringement of the two patents, calling the counterclaims “entirely redundant.”...
