Canada High Court Rejects Damages In Disability Suit

Law360, New York (June 27, 2008, 12:00 AM EDT) -- As employers continue to wrangle with disability issues, the Supreme Court of Canada has raised the bar for proving punitive damages by siding with Honda in a hotly contested wrongful dismissal suit brought by a longtime employee suffering from chronic fatigue syndrome.

On Friday, the Canada Supreme Court delivered the highly anticipated decision, ruling that the lower courts had incorrectly awarded plaintiff Kevin Keays aggravated and punitive damages.
