Gillet Prevails In Antitrust Dispute Over Patent Suit

Law360, New York (June 30, 2008, 12:00 AM EDT) -- An appeals court has cleared tool manufacturer Gillet Outillage from allegations that its patent infringement suit over automobile pliers was brought as a malicious prosecution and in violation of antitrust laws.

The U.S. Court of Appeals for the Ninth Circuit on Monday affirmed a lower court’s grant of summary judgment to Gillet, its U.S. distributor and the law firm that represented the French firm in its patent infringement suit, which has since been dropped, against Taiwan’s Fisher Tool Co. Inc.
