Paint Makers Not Liable For Lead: R.I. High Court

Law360, New York (July 1, 2008, 12:00 AM EDT) -- The Rhode Island Supreme Court overturned a ruling on Tuesday that held Sherwin-Williams Co. and two other companies liable for making and selling lead paint, following in line with a number of other states that have rejected public nuisance claims against manufacturers.

The trial judge was wrong to deny a motion by Sherwin-Williams, NL Industries Inc. and Millennium Holdings LLC to dismiss the case, the high court justices ruled in a 4-0 decision.
