Judge Lifts Stay Of Counterclaims In Ofloxacin Case

Law360, New York (July 09, 2008, 12:00 AM ET) -- Apotex Corp., Canada's largest pharmaceutical company, will be allowed to file antitrust counterclaims in its ongoing patent infringement suit with Daiichi Sankyo Co. Ltd. over an antibacterial ear medicine.

In a consent order filed Tuesday in the U.S. District Court for the District of New Jersey, Judge Madeline Cox Arleo lifted a stay of antitrust counterclaims that Apotex had filed in 2003, but which were later severed in 2004 pending outcome of the patent litigation.
