Dey Launches Suit Over Patent For Respiratory Aid

Law360, New York (April 18, 2006, 12:00 AM EDT) -- In another move to block its patent for respiratory treatment from competitors, Dey LP has fired off a patent infringement lawsuit against generic drug makers Watson Laboratories Inc. and Watson Pharmaceuticals Inc.

Dey filed a complaint in the U.S. District Court for the Central District of California last week after Watson filed an Abbreviated New Drug Application with the U.S. Food and Drug Administration for approval to market generic copies of Dey’s branded DuoNeb bronchospasm treatment even though Dey’s patent has not yet expired.
