NRDC Challenges BP Refinery In Court

Law360, New York (July 10, 2008, 12:00 AM EDT) -- The Natural Resources Defense Council has gone to federal court to try to stop BP Plc's proposed $3.8 billion expansion of its Chicago-area refinery in Whiting, Ind.

The NRDC's complaint, filed Wednesday in the U.S. District Court for the Northern District of Indiana, claims that the proposed construction would entail a “major modification” under the Clean Air Act and therefore requires a “major source permit” instead of the minor one the company secured from Indiana regulators.
