Wyeth, Impax Settle Effexor Patent Dispute

Law360, New York (July 17, 2008, 12:00 AM EDT) -- Wyeth and Impax Laboratories Inc. have agreed to settle a dispute over patents for Wyeth's popular antidepressant Effexor.

Judge Joseph J. Farnan, Jr. of the U.S. District Court for the District of Delaware entered a consent judgment on Tuesday, approving the June 9 settlement. The companies announced the deal Wednesday.

Under the terms of the settlement, Wyeth has licensed Impax to launch its generic version of the drug on or after June 1, 2011. Certain circumstances may allow the generics maker to sell the drug earlier,...
