Law360, New York (July 17, 2008, 12:00 AM ET) -- An appellate judge has upheld a district court decision that Chrysler LLC was not obligated to retroactively include recently retired employees in an early retirement incentive program it offered in 2004.
Judge Michael J. Melloy of the U.S. Court of Appeal for the Eighth Circuit wrote Thursday in an opinion on behalf of a three-judge panel that Chrysler had not violated an implied contract by not including 119 recent retirees in an early retirement offer.
