FCC Vote Over XM, Sirius Merger Is Tied

Law360, New York (July 23, 2008, 12:00 AM EDT) -- The vote count at the U.S. Federal Communications Commission over the controversial Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc. merger was once again tied on Tuesday, after Commissioner Jonathan Adelstein decided to vote against the measure.

Adelstein, one of the Democratic commissioners, said he voted against the merger because it would create a “monopoly with window dressing.”

Last week, Adelstein said that he would vote to approve the buyout if the two companies promised to make certain concessions.
