Shire Sues Actavis Over Carbatrol ANDA

Law360, New York (July 25, 2008, 12:00 AM EDT) -- Shire LLC fired off its third infringement suit of the month Thursday when it sued Actavis Inc. for infringing two patents covering Shire's epilepsy drug Carbatrol.

Shire said it filed its complaint in the U.S. District Court for the Eastern District of Texas in response to Actavis’ abbreviated new drug application for an extended-released capsule containing carbamazepine, the active ingredient in Carbatrol.

Iceland-based Actavis notified Shire in December 2007 of its intent to manufacture a carbamazepine product and repeated its intention earlier this month.
