USPTO Issues Warning On Outsourcing Patent Work

Law360, New York (July 25, 2008, 12:00 AM EDT) -- The U.S. Patent and Trademark Office has cautioned against certain outsourcing practices, issuing a reminder that shipping data about an invention to another country for the purpose of preparing a U.S. patent application may not be legal.

In a notice published in the Federal Register Thursday, the USPTO said inventors that want to get their U.S. patent applications prepared overseas need to get appropriate clearances from the Bureau of Industry and Security at the Department of Commerce before exporting subject matter abroad.
