10th Circ. Nixes Tyson Donning, Doffing Appeal

Law360, New York (July 28, 2008, 12:00 AM EDT) -- A federal appeals court has quashed a bid by Tyson Foods Inc. to strike claims from one of dozens of donning and doffing cases launched by its meat-packing workers.

On Monday, the Tenth Circuit dismissed a challenge by Tyson to a Kansas federal court interlocutory order denying its motion for partial summary judgment in the wage-and-hour case. The circuit court rejected the company's argument that the order altered the Fair Labor Standards Act.
