Ohio Appeals Court Rejects Popcorn Lung Appeal

Law360, New York (July 29, 2008, 12:00 AM EDT) -- Once a state workers' compensation board determined that her lung disease was not related to a chemical found in butter flavoring, a worker in a popcorn machine factory was barred from making that claim in a lawsuit against the manufacturers of the flavoring, an Ohio appeals court has ruled.

The Court of Appeals of Ohio, First District, Hamilton County on Friday affirmed a state court ruling granting summary judgment in favor of the butter flavoring manufacturers, including International Flavors and Fragrances.
