German Court OKs Generic Plavix, Cos. To Appeal

Law360, New York (July 29, 2008, 12:00 AM EDT) -- French drugmaker Sanofi-Aventis and its U.S. partner Bristol-Myers Squibb Co. said Tuesday that they would appeal a German court's decision to immediately authorize marketing of the generic versions of their blockbuster blood thinner Plavix.

The pharmaceutical companies said Tuesday that the European Union shouldn't have reviewed the generic-drug petitions from drug companies Yes and a subsidiary of Ratiopharm until after Plavix's data protection expired on July 15.

“Sanofi-Aventis is convinced (the generics) rely on data originating from Sanofi-Aventis/Bristol-Myers Squibb,” the company said in a statement....
