Judge Smacks Down L'Oreal Lipstick Class Action

Law360, New York (July 29, 2008, 12:00 AM EDT) -- A federal judge has thrown out a purported class action against L'Oreal USA Inc. and Procter & Gamble Distributing LLC that accused the companies of selling Cover Girl and Maybelline lipsticks containing lead.

On Friday, the U.S. District Court for the District of New Jersey ruled that the lawsuit, filed in 2007, could not proceed because the plaintiff lacked standing to sue since she had alleged no injury, harm or ascertainable loss from having purchased the lipstick.
