Pallet Supplier Loses Bid To Toss Antitrust Case

Law360, New York (August 13, 2008, 12:00 AM EDT) -- A judge has quashed a motion by wood pallet giant Chep USA to dismiss an antitrust suit by a group of pallet recycling companies, saying the plaintiffs made a decent showing of monopoly abuse.

In an order Monday, Judge Robert Dawson of the U.S. District Court for the Western District of Arkansas said the pallet recyclers' had offered a plausible argument that Chep — the largest supplier of wood pallets in the U.S. — had breached federal antitrust laws.
