Smith & Nephew Didn't Infringe Polymer Patent: Judge

Law360, New York (August 21, 2008, 12:00 AM EDT) -- A federal judge has granted partial summary judgment to three medical implant makers in a suit filed by Howmedica Osteonics Corp. over a group of patents describing how to produce polymers used in artificial joints.

On Tuesday, Judge William H. Walls of the U.S. District Court for the District of New Jersey ruled that the defendants' products did not infringe the four challenged claims of one of the patents-at-issue, agreeing that the products fell outside of the 2007 claims construction in the case.
