Law360, New York (August 28, 2008, 12:00 AM EDT) -- For the second time, an appeals court has struck down a ruling by the National Labor Relations Board that permitted two Nevada hotels to end union dues checkoff after the hotels' collective bargaining agreement with the union had expired.

Judge Richard Paez of the U.S. Court of Appeals for the 9th Circuit ruled Wednesday that the NLRB erred in holding that the Local Joint Executive Board of Las Vegas, Culinary Workers Union Local 226 and Bartenders Union Local 165 waived their right to continue dues checkoff...
