Judge Stays Generics Companies' Nexium Cases

Law360, New York (August 29, 2008, 12:00 AM EDT) -- A judge on Thursday stayed two noninfringement lawsuits brought by generic-drug makers against AstraZeneca Corp. pending the outcome of AstraZeneca's earlier Nexium-related infringement cases.

Citing the court's power to “control its docket,” Judge Joel A. Pisano ordered the cases brought by Dr. Reddy's Ltd. and Ivax Pharmaceuticals Inc. stayed pending the outcome of related patent infringement actions in U.S. District Court for the District of New Jersey. The judge also said that Dr.Reddy's would not be able to amend its complaint.
