DOJ Opposes High Court Review Of Wetlands Case

Law360, New York (September 02, 2008, 12:00 AM ET) -- The federal government has voiced its opposition to a U.S. Supreme Court petition brought by Mississippi housing developers convicted of violating the Clean Water Act by installing faulty septic tanks that leaked into Gulf Coast wetlands.

The U.S. Department of Justice filed a brief Friday in opposition to the June 2 petition, arguing that the U.S. Court of Appeals for the Fifth Circuit's decision in U.S. v. Lucas withstands competing interpretations of the Clean Water Act.
