Fla. Will Go With The Flow On EPA 'Waters Of The US' Rule

Law360, New York (July 23, 2015, 11:59 AM EDT) -- On June 29, the U.S. Environmental Protection Agency and the U.S. Army Corps of Engineers published the clean water rule, defining "waters of the United States" for purposes of the Clean Water Act. The publication of the final rule did little to dampen the controversy surrounding the rule since its publication as a draft rule in April 2014. Absent congressional or judicial action, the rule will go into effect on Aug. 28. Its impact is highly debated across the country, but Florida's flat terrain, abundant wetlands, existing regulations and potential for third-party lawsuits make Florida unique....
