Ky. Mine Operator Faces Water Pollution Suit

Law360, New York (September 10, 2008, 12:00 AM EDT) -- The Sierra Club and a Kentucky nonprofit have sued a TECO Coal Corp. subsidiary for allegedly dumping fill material into a local creek without a permit.

Clintwood Elkhorn Mining Co., a surface coal mine operator, was hit with the action on Tuesday in the U.S. District Court for the Eastern District of Kentucky after being warned by the Sierra Club and Kentuckians for the Commonwealth Inc. in June that its alleged discharges into a creek near Fishtrap Lake breached a federal water pollution law.
