GSK's Curbs On Parallel Trading May Be Illegal: Court

Law360, New York (September 16, 2008, 12:00 AM EDT) -- A GlaxoSmithKline PLC subsidiary's practice of selling three drugs in Greece on a quota system in order to combat parallel trading may constitute a violation of competition laws, Europe's highest court said Tuesday.

The ruling by the European Court of Justice, which holds that a pharmaceutical company is abusing its dominant position if it refuses to meet “ordinary” orders by wholesalers in order to prevent parallel exports, comes in a long-running court battle Glaxo subsidiary GlaxoSmithKline AEVE has been facing over the practice.
