Law360, New York (September 1, 2015, 10:52 AM EDT) -- "On July 6, 2013, a Boeing 777 hit the seawall that separates the ocean from the end of a runway at San Francisco International Airport." So begins the Seventh Circuit's July 8, 2015, opinion in Lu Junhong v. The Boeing Co., written by Judge Frank Easterbrook, on behalf of a unanimous panel including Chief Judge Diane Wood and Judge Richard Cudahy. The accident was the most significant commercial aviation accident on U.S. soil in over a decade and litigation arising from it has now produced a significant appellate decision. The opinion traverses several jurisdictional lands (and waters) and parts with other courts on some matters along the way. Plaintiffs sought rehearing citing some of those conflicts; that was denied on Aug. 11, 2015. The court's opinion is now final, and its holdings on federal officer removal, appellate jurisdiction to review orders remanding cases to state court, admiralty jurisdiction and removal of admiralty cases would each be a noteworthy legal development standing alone. Altogether they are a highly readable answer key to, as a federal judge elsewhere put it, issues worthy of a difficult law school exam....
