Stem Cell Patent Invalid: Consumer Watchdogs

Law360, New York (September 19, 2008, 12:00 AM EDT) -- A patent on human embryonic stem cells should never have been issued and a patent examiner made two critical errors when ruling that the innovation was patentable, two consumer groups have argued in a re-examination proceeding for the patent.

The groups, Consumer Watchdog and the Public Patent Foundation at the Benjamin N. Cardozo School of Law, filed a brief Thursday with the U.S. Patent Office's Board of Appeals and Interferences challenging the stem cell patent held by the Wisconsin Alumni Research Foundation.
