Qualcomm Ban Withstands Appeal

Law360, New York (September 24, 2008, 12:00 AM EDT) -- An appeals court Wednesday dashed Qualcomm Inc.'s bid to overturn a ban on its cellular chips and software but invalidated one of the three patents asserted by Broadcom Corp., reducing the injunction and $20 million award.

Judges Richard Linn, Daniel Friedman and Sharon Prost of the U.S. Court of Appeals for the Federal Circuit found the district court correctly leveled a permanent injunction against Qualcomm products that infringed two Broadcom patents, but erred in its construction of a third patent’s claims.
