ADA: Applying Performance, Conduct Standards

Law360, New York (September 25, 2008, 12:00 AM EDT) -- On Sep. 9, 2008, the Equal Employment Opportunity Commission (EEOC) issued new enforcement guidance to aid employers in complying with the American with Disabilities Act (ADA).

For the most part, the new enforcement guidelines are consistent with court decisions interpreting the ADA over the last several years, and do not represent any novel concepts or drastic departures from what the majority of courts have been saying.
