Indian Drug Companies Oppose Change to Patent Law

Law360, New York (January 7, 2004, 12:00 AM EST) -- India’s decision to dilute the provision for opposing a patent before it has been granted has upset the domestic pharmaceutical industry, the Economic Times of India reported Wednesday.

Under the Patent Amendment Bill, introduced in Parliament last month, a legally enforceable provision to oppose the granting of a patent will be removed.

The Indian Pharmaceutical Alliance (IPA) and the Indian Drug Manufacturers' Association (IDMA) argue that the removal will harm the local industry and the country, the newspaper reported.
