Equitable Tolling Denied In Tyson MDL

Law360, New York (October 16, 2008, 12:00 AM EDT) -- Ruling that there's no reason for "stale claims" to be rescued in a multidistrict overtime collective action against chicken giant Tyson Foods Inc., a federal judge on Wednesday denied the plaintiffs' motion for equitable tolling.

The litigation, in the U.S. District Court for the Middle District of Georgia, involves actions alleging that Tyson violated the Fair Labor Standards Act by requiring hourly chicken processing employees to perform “off the clock” work.
