Customers Sue T-Mobile Over Late Penalties

Law360, New York (November 11, 2008, 12:00 AM EST) -- T-Mobile USA Inc. imposed overly high late fees on customers who were tardy in paying their bills without calculating the actual damages the company suffered as a result, consumers have charged in a proposed class action against the cell phone service provider.

The lawsuit, lodged in the U.S. District Court of Western Washington last week, accused T-Mobile of violating California's Unfair Competition Law and deceptive practices rules, breaching its contract with customers, and unjust enrichment.
