After Holding Steady, ERISA Litigation On The Rise

Law360, New York (November 13, 2008, 12:00 AM EST) -- Lawsuits claiming violations of the Employee Retirement Income Security Act have plateaued this year after dropping steadily since 2004, but attorneys suspect the seeming decline in filings might actually indicate a shift from individual to class action suits, a better handle on the job of plan administration or even deceptive math, according to the 2009 Law360 Litigation Almanac.
